<\/p>\nJustice Musa Ssekaana of the High Court in Kampala has sentenced Uganda Law Society president Isaac Ssemakadde to two years in jail for contempt of court, issuing an arrest warrant against him.<\/p>\n
The ruling follows a series of derogatory remarks made by Ssemakadde on social media, targeting the judge and the judiciary over an ongoing legal case. The application was filed by Hashim Mugisha, who accused Ssemakadde of undermining the authority of the court and discrediting the trial judge with offensive posts, including on X (formerly Twitter). His comments included accusations of an “unholy alliance” between the judge, the Attorney General, and members of the Uganda Law Society, along with other disparaging remarks.<\/p>\n
In his ruling, Justice Ssekaana emphasized that contempt of court involves any act or statement that undermines the judiciary\u2019s dignity or authority. He pointed out the growing challenge of social media, where individuals use online platforms to attack judges and influence ongoing cases.<\/p>\n

“The protection of courts from attacks of this kind where cases are pending is vital,” the judge noted, adding that such actions, particularly from legal professionals, erode public confidence in the judiciary.<\/p>\n
Justice Ssekaana also cited past rulings affirming the balance between free speech and respect for judicial authority. \u201cThe right of free speech and full expression of opinion are valued rights. Their preservation, however, depends on the observance of the acceptable limit that they must not be used to undermine public order, morality, or the authority of the State,\u201d he stated.<\/p>\n

The court stressed the importance of judicial independence, warning that personal attacks on judges should not be mistaken for legitimate criticism. While judicial officers can be challenged on their rulings, defamatory and intimidating statements meant to influence judicial outcomes must not be tolerated.<\/p>\n
Speaking at the New Law Year event, Chief Justice Alfonse Owiny-Dollo condemned what he described as \u201cvulgar, primitive assaults\u201d on the judiciary. He warned that individuals attacking judicial officers would face the consequences of their actions.<\/p>\n
\u201cSomeone abuses you, makes you feel stupid, and then comes to your house expecting business as usual,\u201d the Chief Justice remarked, reiterating that while criticism is allowed, abuse and intimidation will not be tolerated.<\/p>\n
