Supreme Court to Rule on Kasibante Bid to Withdraw Election Petition

The Supreme Court is set to deliver its ruling on Thursday regarding an application by former presidential candidate Robert Kasibante seeking to withdraw his presidential election petition.

In a notice dated February 23, 2026, issued under the hand and seal of the Registrar, the Court directed all respondents and their legal representatives to appear for the ruling. The notice underscores the importance of attendance by all parties involved in the matter.

According to the communication, failure by any respondent or their counsel to appear—whether in person, through a legal representative, or by an authorised agent—will not halt proceedings. The Court indicated that the ruling may be delivered in their absence.

Kasibante had earlier filed a petition challenging the outcome of the recent presidential election. However, he later submitted an application seeking to withdraw the case, prompting legal arguments on whether the withdrawal should be granted and under what conditions.

Legal analysts say the Supreme Court’s decision will clarify procedural questions surrounding the withdrawal of presidential election petitions, particularly in cases where the matter raises broader public interest considerations.

The ruling is expected to determine whether the petition will formally be discontinued or proceed further under the Court’s guidance.
